If the Parties fail to reach an amicable resolution within the aforementioned thirty (30) day period, the Parties shall proceed to mediation.

      2. Mediation

        If the dispute cannot be resolved through negotiation, the Parties shall submit the dispute to mediation. The mediation shall be conducted in accordance with the rules of the Indian Mediation and Conciliation Centre (IMACC), Bangalore. The mediation shall take place in Bangalore, India, or such other location as agreed upon by the Parties. Each Party shall bear its own costs of mediation. The mediation shall be confidential, and any information or statements made during the mediation process shall not be admissible in any subsequent arbitration or legal proceedings. If mediation fails to resolve the dispute within sixty (60) days from the initiation of mediation, the Parties shall proceed to arbitration.

      3. Arbitration

        Any dispute, controversy, or claim arising out of or relating to this agreement or any breach thereof that cannot be resolved through negotiation or mediation shall be finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996, and its subsequent amendments. The arbitration proceedings shall be conducted by a sole arbitrator appointed by mutual agreement of the Parties. If the Parties are unable to agree on an arbitrator within thirty (30) days of either Party serving a written request for arbitration, the sole arbitrator shall be appointed by the Chief Justice of the High Court of Karnataka or any person or institution designated by the Chief Justice of the High Court of Karnataka.

    3. Jurisdiction

      Any dispute, controversy, or claim arising out of or relating to this Agreement or its breach, termination, or validity, which cannot be resolved through negotiation, mediation, or other non-binding dispute resolution methods as stipulated elsewhere in this Agreement, shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

    4. Venue

      The Parties hereby agree that the appropriate venue for any legal proceedings initiated pursuant to this Agreement shall be the courts located in Bangalore, Karnataka, India. Each Party hereby irrevocably consents to the jurisdiction of such courts and waives any objection it may have to the laying of venue in such courts based on the convenience of the forum or for any other reason.

    5. Seat of Arbitration

      In the event that arbitration is initiated as the method of dispute resolution in accordance with this Agreement, the seat of arbitration shall be Bangalore, Karnataka, India. All hearings, meetings, and proceedings related to the arbitration shall take place in Bangalore, Karnataka, unless the Parties agree otherwise in writing.

    6. Legal Costs

      In any legal proceedings, including arbitration, arising out of or in connection with this Agreement, the prevailing Party shall be entitled to recover from the other Party all reasonable legal fees, costs, and expenses incurred by the prevailing Party in connection with such proceedings, including but not limited to attorney's fees and court costs.

      Costs of Arbitration: In the event Tutort Academy LLP emerges as the prevailing party in any arbitration proceedings, the losing party shall be responsible for refunding Tutort Academy for all legal costs incurred during the arbitration. Conversely, if Tutort Academy is the losing party, Tutort Academy shall be responsible solely for its own legal costs and shall not be liable for any costs incurred by the opposing party.

      Arbitrator's/Judge's Decision: The decision rendered by the arbitrator or judge appointed for the dispute resolution shall be final and binding on all parties involved in the arbitration proceedings.

    7. Waiver of Immunity

      To the extent that any Party has or hereafter may acquire any immunity (sovereign or otherwise) from jurisdiction of any court or from any legal process (whether through service or notice, attachment prior to judgment, attachment in aid of execution, execution, or otherwise) with respect to itself or its property, such Party hereby irrevocably waives such immunity in respect of its obligations under this Agreement and any dispute resolution proceedings related hereto.

    8. Exclusive Forum

      The Parties agree that any legal action arising under or in connection with this Agreement shall be brought exclusively in the courts of Bangalore, Karnataka, India, and irrevocably submit to the personal jurisdiction and venue of such courts for the purpose of any such legal action.

    9. Disputes and Office Location

      Disputes and Venue: Any negotiation, mediation, or arbitration process arising from disputes related to this agreement shall not be conducted at Tutort Academy’s office location. All such proceedings shall be conducted through remote communication means or at a mutually agreed-upon location, as determined by the arbitration or mediation organization chosen to oversee the process.

      Physical Approach to Office Premises: No party or individual shall approach Tutort Academy’s office premises physically to escalate an issue, unless expressly agreed upon in writing by Tutort Academy, and such physical approach shall be permitted only in extremely limited and exceptional circumstances.

      Protection of Office Premises: No person, including learners or any other party, is allowed to visit Tutort Academy’s office premises with the intent to create disturbance, damage property, or engage in any form of misconduct. In the event of any such unauthorized visit resulting in damage or disturbance, the guilty party shall be held responsible for all associated damages and liabilities.

    10. Entire Agreement

      This Law and Jurisdiction Clause constitutes an integral part of this Agreement and supersedes all prior or contemporaneous agreements, understandings, or representations between the Parties regarding the jurisdiction and governing law applicable to this Agreement. This dispute resolution clause shall survive the termination or expiration of this agreement.

  26. Marketing Policy
    1. Use of Advertisement

      Advertising Methods: The Marketing Team at Tutort Academy (hereinafter referred to as "Tutort Academy") is authorized to employ various methods, including but not limited to video advertisements, audio promotions, text links, and any other suitable means, to effectively market Tutort Academy's computer science-related ed-tech courses, products and services.

      Social Media Advertising: Tutort Academy's Marketing Team is permitted to utilize social media platforms and networks for advertising purposes, with the objective of reaching a larger audience and promoting Tutort Academy's offerings.

      Website Link Inclusion: In all advertising materials, Tutort Academy's Marketing Team shall prominently include a direct link to Tutort Academy's official website, [www.tutort.net], to provide interested parties with easy access to detailed information about our products and services.

      Compliance with Platform Policies: All advertisements conducted through social media or other online platforms shall comply with the terms, conditions, and policies of the respective platforms used for advertising.

      Content Accuracy: Tutort Academy shall ensure that all content and claims in advertisements shall be reflective of the features, benefits, and quality of Tutort Academy's courses, products and services to the best level possible. However, it is important to note that while we strive for accuracy, these claims may not always be a 100% match due to various factors. Nevertheless, we are committed to doing our best to satisfy the needs of the learner. Please be aware that every claim made in our advertisements is subject to our terms and conditions.

      Clear Disclosure: Any advertisements that feature endorsements, partnerships, or material connections shall provide clear and conspicuous disclosures in compliance with relevant advertising disclosure guidelines.

      Consent for User-Generated Content: When utilizing user-generated content in advertisements, Tutort Academy shall obtain appropriate consent from the creators of such content, ensuring that they are aware of their content's use in promotional materials.

      Monitoring and Review: Tutort Academy shall regularly review and monitor all advertisements to ensure compliance with these clauses and applicable laws.

      Feedback and Improvement: The Marketing Team is encouraged to collect feedback and data from advertising campaigns to continually refine and enhance Tutort Academy's marketing efforts.

    2. SEO Usage and Keyword Usage

      Ethical SEO Practices: The Marketing Team at Tutort Academy shall engage in ethical and legitimate SEO practices to enhance the online visibility and rankings of Tutort Academy's digital content.

      Keyword Research: Tutort Academy shall conduct comprehensive keyword research to identify relevant and effective keywords and key phrases related to our computer science-related ed-tech courses, products and services. This research shall inform our content creation and optimization strategies.

      Keyword Integration: The Marketing Team shall judiciously integrate selected keywords and key phrases into Tutort Academy's website content, including articles, blog posts, meta tags, and other elements, to improve organic search engine rankings and enhance the user experience.

      Content Quality: Keyword integration shall not compromise the quality, accuracy, or readability of the content. Tutort Academy shall prioritize providing valuable and informative content to users.

      Avoidance of Keyword Stuffing: Tutort Academy shall avoid keyword stuffing, which involves the excessive and unnatural repetition of keywords within content. Keyword usage shall be natural and contextually relevant.

      Compliance with Search Engine Guidelines: All SEO practices shall align with the guidelines and recommendations of leading search engines, such as Google, Bing, and others, to ensure long-term search engine ranking stability.

      Monitoring and Adaptation: Tutort Academy shall continually monitor search engine performance, keyword rankings, and user engagement metrics to adapt SEO strategies and content optimization efforts as necessary.

      Regular Updates: Keyword research and optimization strategies shall be regularly reviewed and updated to reflect changes in industry trends, user behaviour, and search engine algorithms.

    3. Candidate Information Collection

      Ethical Data Collection: Tutort Academy, in its recruitment efforts, may ethically collect publicly available information from potential candidates' profiles on social media platforms, including but not limited to Instagram, LinkedIn, Facebook, and others, for the purpose of evaluating their suitability for employment or engagement with Tutort Academy.

      Respect for Privacy: Tutort Academy shall respect the privacy settings and preferences of individuals on these social media platforms and shall not attempt to access private or restricted information without explicit consent.

      Consent for Contact: Before initiating direct contact with potential candidates identified through social media, Tutort Academy shall seek appropriate consent. The means for candidates to express their interest voluntarily will be a link provided by Tutort Academy that leads them to the sign-up form on Tutort Academy's official website. Candidates may fill in their details voluntarily through this sign-up form to express their interest in pursuing employment or engagement opportunities.

      Data Protection Compliance: The collection, storage, and use of candidate information shall comply with all applicable data protection and privacy laws of India and other relevant regulations.

      Voluntary User Submission: By filling in the details of the sign-up form on Tutort Academy's official website, the user acknowledges and agrees that the submission of their information is entirely voluntary and done of their own free will.

    7. Representation of CTC Hike

      Representation of Salary Increase: Tutort Academy may choose to depict the salary increment of a placed candidate either through the use of percentage growth in their total compensation, actual numerical values, or any other suitable method.

    8. Use of New Company's Name for Marketing

      Marketing Usage: Tutort Academy reserves the right to use the name of the new company where a candidate is successfully placed through Tutort Academy's services for marketing purposes. This may include mentioning the new company's name in Tutort Academy's promotional materials, website, or other marketing channels to showcase our successful Employments and demonstrate the value of our services.

    9. 100% Employment Policy and 100% Hike Representations

      Representational Purposes: Any claims or representations made regarding a "100% Employment policy" or a "100% hike" are primarily for representational purposes.

      Subject to Change/Variation: Tutort Academy acknowledges that the availability of jobs, employment, and salary hikes is subject to change and may vary depending on various factors, including market conditions, individual performance, and external economic circumstances.

    10. Defamation/Negative Review

      Constructive Criticism: Tutort Academy values feedback from all parties, including previous learners and users of our courses, products and services. We encourage constructive criticism and open dialogue as they contribute to our continuous improvement.

      Prohibition of Indecent Language: While providing criticism or expressing dissatisfaction, all parties, including previous learners, users, or any other party, are strictly prohibited from using indecent language, defamatory words, or engaging in any form of harassment or personal attacks in their communications, reviews, or comments related to Tutort Academy.

      Conflict Resolution: In the event of dissatisfaction or concerns, we kindly request that individuals contact Tutort Academy's support team directly. Tutort Academy is committed to resolving issues peacefully and in a smooth manner. Please reach out to our support team at support@tutort.net to discuss any problems or concerns you may have encountered.

      Legal Action: Tutort Academy reserves the right to take legal action if any individual or party engages in defamatory behaviour, harassment, or uses indecent language in violation of this clause, which may result in legal consequences.

  27. Refund Policy
    1. Purpose and Guiding Principles

      The Tutort Academy Refund Policy exists to maintain fairness, transparency, and accountability in handling refund requests from learners who withdraw, face technical issues, or experience program disruptions. It reflects a balance between protecting learners’ rights and ensuring institutional viability, especially for services already rendered (e.g., mentorship sessions, content access, or project evaluation).

    2. Core Principles of Refund Administration
      1. Transparency: All refund-related rules are clearly published on the Tutort website.
      2. Fairness and Proportionality: Refunds are processed proportionately to the level of content access, mentorship utilization, and administrative costs already incurred.
      3. Accountability and Documentation: Each refund request must be formally documented and approved through a verifiable workflow.
      4. Final Decision Authority: The Tutort Academy Management Team retains the final right to interpret and approve or decline refund requests after examining all evidence, timelines, and compliance with policies.

    3. Refund Eligibility Window (Cooling-off Period)
      1. Standard Cooling-Off Period: Learners may apply for a refund within 14 calendar days of course commencement and before accessing more than 20% of the total course content. Refund is only applicable on the basis of course quality and services; personal reasons or concerns are not eligible.
      2. Beyond Cooling Period: Refunds after the 14-day window are typically not permitted except under exceptional circumstances approved by the Management Team.

    4. Non-Refundable Components

      4. Step 4 – Management Review: The Tutort Academy Management Team reviews the recommendation and issues the final approval or rejection within 10–15 working days.
      5. Step 5 – Disbursement: Approved refunds are credited to the original payment source within 7–10 working days after final approval.
      6. Step 6 – Confirmation: A formal confirmation email is sent to the learner with details of the transaction and the reason for the decision.
    7. Refund Denial Conditions
      1. The learner has accessed more than 20% of the total course content.
      2. The refund is requested after 14 calendar days from course commencement (except under force majeure conditions).
      3. The learner is disqualified due to policy violation, plagiarism, or code of conduct breach.
      4. The learner fails to meet attendance, access, or project requirements but still requests a refund after participation.
      5. The course was purchased under a non-refundable promotional scheme, scholarship, or combo package.
      6. Placement assistance has already been availed (even partially).
    8. Refunds for Double or Excess Payments
      1. Duplicate Payment Verification: If a learner accidentally pays twice for the same course, the excess payment is refunded in full within 7 working days after verification.

Appointment and Role: Tutort Academy, represented herein as "Provider," designates a Operations Manager as Point of Contact (POC) to serve as the primary communication channel between the program participant, referred to as "Participant," the coach, and Tutort Academy. The POC shall facilitate effective communication, manage program-related inquiries, and ensure the orderly progression of the program.
      2. Feedback and Communication: We welcome participants to share their valuable feedback, concerns, or requests using our designated communication platform, currently Email(Please note that this platform may be subject to change, transitioning to our proprietary communication channel integrated into the portal. The Point of Contact (POC) is committed to promptly and effectively addressing and resolving such issues as a top priority.
    2. Escalation Contact
      1. Resolution of Unaddressed Concerns: Provider places a high priority on Participant satisfaction and engagement in the program. If the Participant's questions or feedback remain inadequately addressed by the team or the designated POC, the Participant retains the option to escalate the matter to the designated Operations Manager (POC).
    3. Participant Commitment
      1. By participating in the Tutort Academy’s program, the participant expressly agrees to:
      2. Maintain consistent communication with the assigned POC for effective program management.
      3. Utilize the escalation contact, if necessary, to ensure prompt and satisfactory resolution of any unresolved matters.
    Tutort Academy is dedicated to delivering exceptional support and fostering a positive learning experience for all participants. The participant’s commitment to actively engaging with the designated POC and utilizing the escalation contact, if required, plays a significant role in achieving this objective. Provider highly values Participant's involvement and feedback, which significantly contributes to the continual enhancement of its programs and services.
  29. Eligibility for the Employment Process
    1. Age Requirement
      1. To participate in the Employment process facilitated by the Program, you must strictly adhere to the age criteria. You shall be required to be above the age of 18 (eighteen) years and below the age of 35 (thirty five) years at the time of submitting your application.
    2. Educational Qualifications
      1. It is mandatory that you have successfully obtained a Bachelor's degree from an institution duly recognized in India.
    3. Submission of Valid Documents
      1. You shall bear the responsibility of furnishing valid mark sheets and other essential documents for evaluation as and when requested by Tutort Academy.
    4. Legal Work Authorization
      1. As a fundamental prerequisite, you must possess legal authorization to work in India without necessitating any form of sponsorship.
    5. Proficiency in English
      1. Mastery of both written and spoken English is an indispensable criterion for eligibility.
    6. Availability on Communication Platforms
      1. You shall consistently maintain availability on communication platforms, including but not limited to Email, throughout the entire week, commencing from Monday and concluding on Sunday, during the hours between 10 AM and 7 PM.
    7. Timely Joining Commitment
      1. Should you receive an employment offer and choose to accept it, you must be prepared to commence your employment with the offering company within a period of 25 (twenty-five) days from the date of your acceptance of the offer.
    8. Submission of Essential Documentation
      1. At the discretion of Tutort Academy, you may be obligated to provide your resume, particulars concerning your educational background, and any relevant work experience, if applicable. Furthermore, you may be requested to furnish any additional details or personal identification documents deemed necessary by Tutort Academy to facilitate the Employment process.
    9. Work Experience Clarification
      1. Please take into consideration that certain job positions may necessitate a specific number of years of pertinent work experience. In the event that your experience does not directly align with the available position, you may be categorized as either a 'Fresher' or 'Non-Experienced' candidate, potentially affecting your eligibility to proceed with the Employment process.
    10. Tutort Academy's Efforts in Providing Opportunities
      1. While Tutort Academy diligently strives to align relevant employment opportunities through the Program, it is imperative to recognize that we do not guarantee any minimum or maximum number of employment opportunities. The availability of opportunities is contingent upon external factors and remains subject to the discretion of prospective employers.
    11. Acknowledgment and Consent
      1. By engaging in the Employment process facilitated by the Program, you hereby acknowledge and provide your consent to the aforementioned eligibility criteria. It is your responsibility to ensure that you consistently meet the stipulated requirements throughout the process to uphold your eligibility for potential employment opportunities facilitated by Tutort Academy. Kindly undertake a comprehensive review and understanding of these criteria before proceeding further.
    12. Employment Readiness Criteria
      1. The learner acknowledges that Tutort Academy may establish Employment readiness criteria, which will be communicated upon the commencement of the batch. Learners must meet and clear these criteria to become eligible for employment opportunities.
    13. Employment Assistance Disclaimer
      1. Tutort Academy provides employment assistance to learners but does not guarantee employment. Learners should understand and acknowledge that the Employment process aims to facilitate opportunities; however, the final outcome depends on various external factors beyond Tutort Academy's control, such as market conditions and employer decisions.
  30. Admissions Policy
    1. Reservation and Admission Process
      1. Upon the successful completion of the payment, your seat shall be reserved, and your candidature shall be transferred to the admissions team for further processing. The admissions team will evaluate your eligibility for participation in the learning experience and subsequent allocation into a live class cohort.
    2. Onboarding Timeline
      1. The Admission Point of Contact (Admission POC) will commence the onboarding process no later than days following the receipt of the complete payment for the course. It is imperative that, during the course registration, you provide accurate details for communication to ensure efficient outreach by Tutort Academy.
    3. Learning Journey Evaluation
      1. Throughout the admission process, your learning journey shall be subject to evaluation by Tutort Academy. Tutort Academy reserves the exclusive right to determine your suitability to commence your learning journey or otherwise.
    4. Communication Channel
      1. Communication Obligation: You are required to actively participate in communication through our designated channel, which currently operates through Email and over WhatsApp group. Any missed notifications or messages resulting from your non-participation shall not be attributed to Tutort Academy's responsibility.
    5. Commencement of Classes
      1. The learner acknowledges and agrees that upon payment of the complete course fee, they are expected to commence their classes within a period not exceeding 45 days from the date of payment, unless Tutort Academy does not have a batch starting within that 45-day timeframe.
    6. Conclusion of Admission Phase
      1. The Admission phase shall be deemed concluded once you have successfully attended the Onboarding session and your classes have duly commenced.
    By engaging in the admission process and subsequent learning journey with Tutort Academy, you hereby acknowledge and consent to the terms and conditions set forth herein.   31. Learning/Coach Policy
    1. Maintenance of Discipline and Respect
      1. You shall adhere to strict discipline within the learning channels and treat your colleagues and the Operations team’s Point of Contact (POC) with due respect at all times.
    2. Consequences of Indisciplinary Actions
      1. Any act of indiscipline shall result in severe consequences, including suspension or termination being taken against you.
    3. Coach/Mentor Changes
      1. Coach/Mentor changes may occur during your learning journey due to unforeseen circumstances. Tutort Academy will ensure a smooth transition between coach changes to minimize disruption to your learning experience.
    4. Turn-around Time (TAT) for Coach Change
      1. The TAT for coach changes shall not exceed 3 weeks. This duration accommodates our rigorous evaluation process to provide you with the best possible learning experience.
    5. POC Evaluation and Inactivity
      1. During your learning journey, a POC will evaluate your progress. Failure to be actively available for the POC may result in your declaration as "Inactive" and subsequent removal from the course.
    6. Mentor Sessions
      1. Mentor sessions are available upon request, and you must contact your POC to request a mentor session.
    7. Contact Information
      1. For queries and concerns, you may directly contact your Operations Manager POC. Additionally, you may send an email to support@tutort.net.
    8. Escalations
      1. Individual escalations will be addressed on a case-by-case basis. Group escalations will not be entertained by Tutort Academy. Any attempt by a learner to incite others will result in the suspension or termination of the guilty learner from the program, along with any collaborating learners.
    9. Course Completion and Unforeseen Circumstances
      1. Tutort Academy will make every effort to complete the course within the stipulated time. However, if course completion is delayed due to unforeseen circumstances, Tutort Academy disclaims any liability and will endeavour to finish the course to the best of its ability.
    10. Plagiarism
      1. Plagiarism is strictly prohibited at Tutort Academy. Any learner found guilty of plagiarism will be terminated from Tutort Academy.
    11. Responsibility for Unforeseen Delays
      1. Tutort Academy shall not be held responsible for any delays arising from unforeseen circumstances originating from the learner, including but not limited to health conditions, workplace projects, or job loss. Tutort Academy will offer assistance but shall not accept liability or entertain claims related to such delays.
    By participating in the learning program offered by Tutort Academy, you hereby acknowledge and consent to the terms and conditions outlined herein. Please review these terms diligently before proceeding further, as they constitute an integral part of your agreement with Tutort Academy.
  32. Communication Channels
    1. Communication with POC
      1. Queries or doubts should be directed to the designated POC by sending an email to support@tutort.net. The response time for such queries shall not exceed 1 week, and the resolution time shall have no specified limit, as it depends on the learner's response time.
    2. Code of Conduct
      1. Learners are expected to maintain a respectful and courteous demeanor, treating all participants with respect.
    3. Group Escalations
      1. Group escalations are strictly prohibited. Any learner found guilty of initiating or participating in group escalations will not be entertained. By participating in the learning program, you hereby acknowledge and consent to the terms and conditions outlined herein. It is imperative to review these terms thoroughly before proceeding further, as they constitute a binding agreement between you and Tutort Academy.
  33. Employment Readiness Policy
    1. Employment Assistance Clarification
      1. It is essential to clarify that while Tutort Academy commits to providing Employment assistance, such commitment does not guarantee Employment. The process of securing Employment is a collaborative effort, dependent on your active participation and efforts.
    2. Eligibility for Employment Opportunities
      1. To become eligible for Employment opportunities facilitated by Tutort Academy, you must actively engage in the prescribed efforts and meet the specified criteria.
    3. Employment Ready Policy and Conditions
      1. The criteria for Employment readiness are predicated on conditions that are reasonably achievable during the course duration. These conditions shall be communicated to you at the commencement of the coaching session within your batch.
    4. Modification of Employment Readiness Criteria
      1. Tutort Academy retains the discretionary authority to modify the criteria for Employment readiness based on the specific requirements and preferences of partnering companies. By participating in the learning program offered by Tutort Academy, you hereby acknowledge and consent to the terms and conditions outlined herein. It is crucial to review these terms thoroughly before proceeding further, as they constitute a legally binding agreement between you and Tutort Academy.
  34. Batch Transfer, Deferral & Re-Enrollment Policy
    1. Purpose
      1. This policy defines the conditions under which learners may transfer, defer, or re-enroll in another batch or program at Tutort Academy. It ensures flexibility for learners facing unavoidable circumstances while maintaining academic continuity and fairness in resource allocation.
    2. Eligibility for Batch Transfer
      1. Valid Reasons
        1. One-time Batch transfers may be requested for legitimate reasons such as:
          1. Job relocation or shift in work schedule.
          2. Medical or family emergencies.
          3. Course extensions due to festival breaks or mentor unavailability.
          4. Technical or connectivity limitations affecting attendance.
      2. Conditions
        1. The learner must have completed less than 50% of the course at the time of transfer request.
        2. All previous dues must be cleared.
        3. The new batch must have available seats and be of the same program type.
      3. Application Process
        1. Learners must apply through the official Batch Transfer Form available on the dashboard.
        2. Requests are accepted up to 15 days before the current batch end date.
      4. Approval Authority
        1. All transfers are reviewed and approved by the Tutort Academy Management Team, whose decision is final and binding.
    3. Deferral (Pause and Resume Option)
      1. Purpose
        1. Deferral allows learners to temporarily pause participation one time and resume in a future batch within six (6) months without losing access rights.
      2. Eligibility
        1. Deferral requests are accepted once per enrollment.
        2. The learner must submit valid documentation for emergencies (e.g., medical certificates, employer letters).
      3. Impact on Course Duration
        1. Upon approval, the learner’s course access is paused, and the remaining sessions can be resumed in a later batch.
        2. Duration already studied remains credited; repetition of completed modules is optional.
      4. Management Discretion
        1. The Management Team evaluates each deferral on a case-by-case basis.
        2. In the event of widespread disruptions (festivals, natural calamities), collective deferrals may be processed automatically without penalty.
    4. Re-Enrollment Policy
      1. Definition
        1. Re-enrollment refers to joining the same or equivalent program after completion, withdrawal, or lapse of access.
      2. Eligibility & Fees
        1. Learners wishing to refresh skills or rejoin after expiry of the six-month placement period may re-enroll at a discounted alumni rate (up to 40% concession, subject to policy at the time).
        2. New re-enrollments are treated as independent admissions for administrative purposes.
      3. Academic Recognition
        1. Prior coursework or project credits may be recognized at the discretion of the Academic Head.
        2. Duplicate certificates will not be issued unless re-enrollment includes full reassessment.
    5. Impact on Placement and Assistance
      1. Learners transferring or deferring retain placement eligibility, provided all academic criteria are met upon completion of the new batch.
      2. The six-month placement assistance period begins from the date of completion in the new batch, not from the original enrollment.
      3. Refunds are not applicable once a batch transfer or deferral is approved.

  35. Suspension and Termination of Courses/Services

    2. Prohibition of Misconduct

In the pursuit of maintaining the integrity of our educational programs, it is imperative to emphasize that any form of misconduct, including but not limited to cheating in tests, mock interviews, or engaging in other deceptive practices aimed at undermining the upskilling process, is strictly prohibited.
    3. Consequences of Misconduct
      1. Instances of learner misconduct that compromise the integrity of the educational process may lead to decisive actions, including the suspension of services.
    4. Notification of Suspension
      1. In the event of suspension due to misconduct, learners shall be duly notified through their original email ID to ensure awareness of the situation.
    5. Repeat Offences and Termination
      1. Upon a repeat occurrence of misconduct from a learner, Tutort Academy reserves the unequivocal right to terminate its services and access to the course without providing a refund.
      2. By enrolling in Tutort Academy's educational programs, you acknowledge and agree to abide by the principles of integrity and commitment to quality education outlined herein. Please take careful note of these terms, as they constitute a legally binding agreement between you and Tutort Academy.
      3. Students are required to use only the official Tutort Academy communication groups for all academic and institutional purposes. The creation or participation in any unofficial groups, channels, or platforms that represent or are associated with Tutort Academy is strictly prohibited.
      4. Any violation of this policy may result in disciplinary action, as determined by the management. The management reserves the sole and final authority to make decisions regarding such matters.
  36. Product Issues
    1. Learning Portal Performance
      1. Tutort Academy hereby disclaims any responsibility for the performance or availability of the learning portal. In the event of a disruption or downtime of the portal, the Turnaround Time (TAT) for resolution shall be 1 week.
    2. Beta Features and Potential Bugs
      1. All new beta features introduced on the portal, intended for the enhancement of the learning experience, are susceptible to containing bugs or issues. Tutort Academy shall not be held accountable for any disruptions in learning resulting from such bugs. The TAT for resolving these bugs shall be 1 week.
    3. Reporting Portal Issues
      1. Learners encountering issues with the learning portal are encouraged to promptly report them to their designated Point of Contact (POC) via email to support@tutort.net. Failure to do so absolves Tutort Academy of any responsibility for resolving issues affecting the respective learner.
    4. By engaging with Tutort Academy's learning portal, you acknowledge and accept the terms and conditions detailed herein. Please review these terms carefully, as they constitute a legally binding agreement between you and Tutort Academy.
  37. Unofficial and Official WhatsApp or any Social Media Groups Usage
    1. Tutort Academy takes pride in fostering a positive and constructive learning environment for all of our learners. To maintain the integrity of our community and protect the interests of all participants, we have established the following guidelines regarding the use of unofficial WhatsApp groups and other social media platforms:

      1. Learners and any other individuals associated with Tutort Academy are strictly prohibited from creating or participating in unofficial WhatsApp groups or any unofficial groups on other social media platforms for the purpose of discussing details about Tutort Academy.
    3. Responsible and Respectful Communication
      1. Learners are expected to engage in responsible and respectful communication within our official communication channels. This includes refraining from spreading false information, hateful content, expressing dissatisfaction, or inciting negativity about Tutort Academy to their peers.
    4. Consequences of Violation
      1. Any individual found to have violated this clause by creating or participating in unauthorized groups and engaging in harmful activities as described above will face the following consequences:
      2. First Violation: A warning will be issued, and the individual may be subject to temporary suspension from Tutort Academy's services. The duration of this suspension shall be determined by Tutort Academy based on the severity of the violation.
      3. Second Violation: If an individual is found to have violated this clause for a second time, they will face permanent suspension from the course and all Tutort Academy services. No refunds will be provided for any paid amounts, and the individual will no longer be eligible for any future benefits from Tutort Academy.
    5. Reporting Violations
      1. Learners are encouraged to report any violations of this clause to Tutort Academy's support team for prompt investigation and appropriate action.
    6. We emphasize that this clause is in place to maintain a positive and productive learning environment for all participants. We expect all learners and individuals associated with Tutort Academy to adhere to these guidelines and contribute to the overall well-being of our community.
    7. Strict Official Communication Policy
      1. Learners are explicitly prohibited from initiating discussions with their peers. Any queries or issues must be directed exclusively to the support team or management for resolution.
    This policy is crucial to maintain the anonymity of learners and uphold their privacy. Tutort Academy places a strong emphasis on safeguarding learner anonymity, recognizing that disclosure may have significant consequences. Violation of this policy will result in the actions outlined in the preceding sub-clauses being applied.
  38. Course Finance
    1. EMI Payment Options
      1. Tutort Academy offers EMI (Equated Monthly Installment) plans to facilitate easy payment of course fees for our learners. We have partnered with third-party finance providers, to provide flexible EMI options to our learners.
    2. Responsibility for EMI Repayment
      1. Once a learner opts for the EMI payment option, it is the learner's responsibility to manage and make repayments directly to the chosen finance provider. Tutort Academy does not assume any responsibility for the financial aspect of the EMI arrangement. Our commitment is solely to provide the educational services promised in the course.
      2. Any queries, concerns, or issues related to EMI payments, including changes, delays, or difficulties, must be communicated directly to the finance provider with whom the learner has collaborated at the outset.
    3. Cancellation of EMI
      1. Cancellation of EMI plans is subject to the terms and conditions set forth by the chosen finance provider. Learners must adhere to the cancellation policies and procedures defined by the finance provider to initiate and complete the cancellation process. Tutort Academy is not involved in the cancellation of EMI plans and cannot facilitate or influence this process.
    4. Discrepancies in Interest Rates
      1. In the event of any discrepancies or concerns regarding the interest rates associated with the EMI plans, learners are advised to directly address and resolve these issues with the respective finance provider. Tutort Academy does not have control over or influence on the interest rates set by third-party finance providers and cannot intervene in such matters.
      2. Please note that the finance-related aspects, including EMI plans and their management, are entirely between the learner and the chosen finance provider. Tutort Academy's role is limited to delivering the vocational courses as described in our course offerings. Learners are encouraged to review the terms and conditions provided by the finance provider and seek clarifications directly from them for any financial-related queries or concerns.
  39. Impersonation and Fraudulence
    1. Impersonation and Fraudulent Activities Prohibited
      1. Tutort Academy maintains a strict policy against impersonation and fraudulent activities within our program, platform, and services. Any individual found engaging in such activities will be subject to disciplinary action.
    2. Unauthorized Use of Identities
      1. Learners are strictly prohibited from impersonating others or using false identities while interacting within Tutort Academy's platform. This includes, but is not limited to, using someone else's name, photo, or personal information without consent.
    3. Fraudulent Claims and Misrepresentations
      1. Learners are prohibited from making false or fraudulent claims, misrepresentations, or providing inaccurate information about themselves or their qualifications within Tutort Academy's platform or during interactions with other learners or staff members.
    4. Unauthorized Access and Manipulation
      1. Unauthorized access to Tutort Academy's systems, data, or resources, as well as any manipulation, alteration, or unauthorized use of Tutort Academy's course content or services, is strictly prohibited and may result in disciplinary action.
    5. Consequences of Impersonation and Fraudulent Activities
      1. Violation of this impersonation and fraudulence clause may lead to the following consequences:
        1. Warning: Tutort Academy may issue a warning to the individual involved in impersonation or fraudulent activities as a first step.
        2. Temporary Suspension: Depending on the severity of the violation, Tutort Academy reserves the right to temporarily suspend the learner's access to our platform and services. The duration of suspension will be determined by Tutort Academy.
        3. Permanent Suspension: In cases of repeated or serious violations, Tutort Academy may terminate the learner's access to our platform and services.
    6. Reporting Violations
      1. Tutort Academy encourages learners and staff members to report any suspected cases of impersonation or fraudulent activities promptly. Reports can be submitted to our dedicated support team for investigation.
    7. Legal Consequences
      1. In addition to the actions taken by Tutort Academy, individuals engaged in impersonation and fraudulent activities may also be subject to legal consequences as per applicable laws in India.

      1. Both employees and learners are expected to respect intellectual property rights. Unauthorized use, reproduction, or distribution of Tutort Academy's content, materials, or resources is strictly prohibited.
    5. Anti-Harassment and Non-Discrimination
      1. Tutort Academy is committed to providing a safe and inclusive environment free from harassment, discrimination, and intimidation. Both employees and learners are expected to uphold this commitment by refraining from any form of harassment or discrimination based on race, gender, religion, sexual orientation, or any other protected characteristic.
    6. Confidentiality and Privacy
      1. Employees and learners are expected to maintain the confidentiality of personal and proprietary information shared within Tutort Academy's platform. Any information shared in confidence must not be disclosed or used for any unauthorized purposes.
    7. Reporting Violations
      1. Both employees and learners are encouraged to promptly report any violations of these rules or any other concerns to Tutort Academy's dedicated support team for investigation and appropriate action.
    8. Consequences of Violations
      1. Violation of these rules may result in disciplinary actions, including warnings, temporary suspension, or permanent expulsion from Tutort Academy's platform, depending on the severity and frequency of the violation.
    By participating in Tutort Academy's courses, programs and services, both employees and learners acknowledge their understanding and acceptance of these rules.   41. Threats and Harmful Actions
    1. By accepting these terms and conditions, the learner explicitly agrees not to use threats, coercion, or manipulation against Tutort Academy LLP. This includes threats of self-harm or harm to third parties with the aim of obtaining a refund or specific actions.
    2. If a learner communicates an intention to take extreme measures or cause harm to themselves or others, Tutort Academy LLP reserves the right to report such concerns to the relevant authorities. The learner acknowledges that Tutort Academy LLP cannot be held responsible for any consequences resulting from such actions, and the learner is solely accountable for the outcomes of their conduct.
      In line with its commitment to the well-being of learners and the community, Tutort Academy LLP will promptly notify the appropriate authorities if a learner expresses a desire to take extreme steps or cause harm. This action is taken to ensure the safety and well-being of the learner/user.
    3. Additionally, the same terms and obligations outlined in this clause apply to all stakeholders associated directly or indirectly with Tutort Academy LLP. This includes but is not limited to employees, contractors, partners, and any other individuals or entities engaged in activities related to Tutort Academy LLP.
